These terms set out the basis on which Ratana Niti provides legal services to clients. We ask that you read them carefully before engaging our services or using this website. If anything is unclear, please contact us and we will be happy to explain.
1. About Ratana Niti
Ratana Niti is a legal practice registered and operating in Thailand, with offices at 88 Rama IV Road, Pathum Wan, Bangkok 10330. We provide legal services relating to pension matters, including entitlement reviews, dispute correspondence, and formal appeals before relevant bodies.
All legal work is carried out or supervised by qualified lawyers admitted to practice in Thailand. We are committed to conducting our practice in accordance with the Lawyers Council of Thailand's professional standards and the Legal Profession Act B.E. 2528.
2. Scope of These Terms
These terms apply to:
- All visitors to this website (ratananitilaw.com or any domain registered for this practice)
- Prospective clients who make an enquiry or request a consultation
- Clients who have engaged Ratana Niti to provide legal services
Where a client engagement agreement is signed, its terms will take precedence over these general terms in the event of any conflict. These terms do not constitute legal advice and do not create a solicitor-client relationship merely by virtue of visiting this website.
3. Our Services
We offer three areas of pension legal support:
- Pension Entitlement Review (฿4,500) — A careful review of pension rights and recent changes, with a written summary and clear next steps.
- Dispute Advisory & Correspondence (฿10,500) — Considered support for pension decisions that appear unfair or unclear, including document preparation and correspondence with the relevant body.
- Full Representation & Appeals (from ฿17,400 per phase) — Comprehensive management of formal appeals or tribunal proceedings, with full case management and a cost outline before each phase begins.
Services are described in plain terms on our website and in our engagement letters. We will not begin work on a matter until we have confirmed the scope, fee, and any applicable conditions in writing.
4. Fees and Payment
Our fees for standard services are set out on this website and confirmed in each engagement letter. Fixed-fee services are invoiced upon commencement of work unless otherwise agreed. For phased services (such as Full Representation & Appeals), a cost outline is provided before each phase and no work on that phase proceeds until the client has confirmed acceptance in writing.
Fees are payable in Thai Baht (THB). Payment methods accepted include bank transfer to our designated client account. We will issue a formal invoice for all fee arrangements.
Disbursements (filing fees, official document charges, courier costs, and similar third-party expenses) are charged separately at cost and disclosed in advance wherever possible.
If a matter ends before all agreed work is completed, we will account for fees on a fair and proportionate basis, reflecting work done to that point.
5. Client Responsibilities
To allow us to work effectively on your matter, we ask that you:
- Provide accurate, complete, and timely information relevant to your matter
- Promptly supply documents, signatures, or instructions we request
- Notify us of any change in your contact details, circumstances, or intentions
- Respond to correspondence within a reasonable time — typically within 10 working days unless urgency requires otherwise
- Make clear any deadlines you are aware of that may affect your matter
We cannot be held responsible for adverse outcomes that arise from inaccurate or incomplete information provided by you, or from delays caused by a failure to respond or provide materials in reasonable time.
6. Limitations of Our Advice
Our advice is based on the law and regulations in effect at the time it is given. Thai pension law and related regulations may change; while we endeavour to keep our knowledge current, advice given at an earlier date may not reflect subsequent changes unless we have specifically addressed those changes with you.
We provide advice specific to your matter and the facts you share with us. We do not accept responsibility for reliance on general information published on this website, which is provided for informational purposes only and does not constitute legal advice.
Outcomes in legal matters, particularly those involving disputes, appeals, and tribunal proceedings, cannot be determined in advance. We will provide our honest assessment of the position at each stage, but we make no assurances regarding the outcome of any matter.
7. Confidentiality
We hold all client communications and matter information in strict confidence. Information you share with us in connection with a matter will not be disclosed to third parties except:
- Where necessary to progress your matter (for example, submitting documents to a pension authority or tribunal)
- With your express prior consent
- Where required by law, a court order, or the Lawyers Council of Thailand's professional obligations
Our confidentiality obligations extend beyond the conclusion of any engagement and are binding on all members of our practice and any authorised third parties who assist with your matter under confidentiality undertakings.
8. Conflicts of Interest
Before accepting any new matter, we carry out a conflict check. If we identify a potential conflict of interest between your matter and an existing client, we will explain the position to you and seek your informed consent before proceeding, or we will decline to act if the conflict cannot be appropriately managed. We ask clients to notify us promptly if they become aware of any circumstances that might give rise to a conflict.
9. Website Content and Intellectual Property
All content on this website — including text, layout, and structural elements — is the property of Ratana Niti or its content providers. You may view and print pages for personal, non-commercial reference but you may not reproduce, redistribute, or use the content in any other way without our prior written consent.
Written work product we produce for your matter (such as correspondence, submissions, or written advice) is provided for your use in that matter. It may not be published, shared commercially, or used in other proceedings without our prior written consent.
10. Ending an Engagement
You may end our engagement at any time by notifying us in writing. We will account for work completed to that point and provide any documents belonging to you. Any unpaid fees for work already completed remain due.
We may end an engagement in circumstances that make it professionally inappropriate for us to continue — for example, if we discover that information provided to us was materially inaccurate, if instructions conflict with professional obligations, or if fees are not paid in accordance with agreed terms. We will give reasonable notice and assist with an orderly transition where possible.
11. Complaints
We take complaints seriously and aim to address them promptly and fairly. If you are dissatisfied with any aspect of our service, please contact us in writing at [email protected] or at our office address. We will acknowledge your complaint within 5 working days and respond fully within 20 working days.
If we are unable to resolve a complaint to your satisfaction, you may refer the matter to the Lawyers Council of Thailand, which oversees professional conduct for legal practitioners in Thailand.
12. Limitation of Liability
Our liability to clients is limited to losses directly and foreseeably caused by our negligent acts or omissions. We are not liable for indirect, consequential, or speculative losses, or for losses arising from circumstances outside our reasonable control.
Nothing in these terms excludes or limits liability for fraud, death, or personal injury caused by negligence, or for any other matter that cannot lawfully be excluded under Thai law.
We maintain professional indemnity insurance in accordance with the requirements of the Lawyers Council of Thailand. Details of our coverage are available on request.
13. Governing Law and Jurisdiction
These terms, and any engagement with Ratana Niti, are governed by the laws of Thailand. Any dispute arising from the use of this website or the provision of legal services shall be subject to the non-exclusive jurisdiction of the courts of Bangkok, Thailand.
14. Amendments to These Terms
We may update these terms from time to time to reflect changes in law, regulation, or our practice. The date of the most recent revision is displayed at the top of this page. For active client engagements, any material change will be communicated to you directly.
